Air conditioning
All Vacation homes in Florida in the Disney area are provided with air conditioning and air heating as a standard amenity.
Guests should note that the normal operating temperature range for air conditioning is central Florida vacation homes is between 74-80 degrees Fahrenheit.
Guests staying at a Orlando vacation home should also note that to ensure the best operating temperature range, the doors and windows of the Vacation home in Florida in which they are staying should be kept closed. A continued failure by a staying guest to keep doors and windows closed during Summer season can easily cause a break-down in the air conditioning, and additional charges may be applied.
Linens and towels
All vacation homes in Florida from villa are all provided with linens and towels for our guests. An inspection count is performed to ensure that quantities are maintained at or above the required number to provide sufficient for each guest party.
Guests should note that, in keeping with industry norms, all linens and towels are cleaned on premises after the departure of each guest party. Regrettably, there is insufficient time to press/iron linens or towels at vacation homes between guests.
Swimming pool and/or spa pool
Guests staying at a Villa Florida pool homes, and in the majority of the town homes offered will have their own private swimming pool or spa. These private pools are for the enjoyment of our guests and are serviced every week by Villa pool technicians (quite often while your family are at the parks and attractions).
All of the pools and/or spa pools at the vacation homes that Villa rents to guests are optionally heated by either gas or electric heat pumps. For details on the differences, please click on the links. Where pool heat is chargeable, it is clearly noted on your quote, and will also be clearly shown on your booking confirmation. Pool heat is only recommended to guests between October and March each year.
The true test of a clean pool is to see if the water itself is clear. All Villa managed pools are treated with the correct level of chemicals to ensure that the water remains clear and clean for guests. On larger homes, this sometimes means 2 visits per week during the Summer months, as evaporation can alter the chemical balance.
If there is sand or debris on the bottom of the pool, it will be removed on the next service. Sand in the pool or on the deck should not be regarded as a problem by guests. Here in Central Florida, there is always building and road improvement in progress, and air-borne sand is blown or washed (by rain) on to the pool screen enclosures and on to the pool and deck on a daily basis. Bugs and geckos are a part of daily life here in Florida. At certain times of year, it becomes impossible to maintain a pool that is totally free of bugs. Fortunately, they drop to the bottom of the pool and are filtered through the pool drain.
Guests staying at a Villa managed home without a private pool will enjoy the benefit of a community pool at the clubhouse. All vacation homes offered by Villa are located on gated resorts or communities with a clubhouse and community pool.
Cutlery, crockery, pots and pans
Each of the Orlando vacation homes that we offer to guests is completely furnished and equipped to help you to enjoy your vacation without the need to pack everything when you come to visit Walt Disney World and the theme parks here in Orlando, Florida. All kitchens at vacation homes, condos are equipped with a suitable quantity of knives, forks, spoons, cups, plates, bowls, glasses, tumblers, pots and pans for cooking.
Guests should note that owner recommends a level of pots and pans to its property, but occasionally, the vacation home in which you are staying may not have enough for your needs. Guests should note that such cutlery, crockery, pots and pans as are provided are cleaned in a dishwasher on the premises, and may not be sterilized.
Standard equipment
All Disney vacation homes offered by owner are provided with a standard level of kitchen appliances such as cooker, stove, range, microwave, refrigerator, dishwasher, garbage disposal, coffee maker, kettle, washer, dryer, iron and board. Many also have additional items such as mixer, hairdryers, dehumidifiers, water softeners or purifier filters.
Guests should expect that the vacation home at which they stay will have the standard items provided.
Games rooms
Over 50% of the Florida vacation homes offered by owner are provided with a games room for our guests enjoyment. Where a games room is provided at one of the Florida pool homes that we offer, then it will be located in either the garage or in a loft area. Guests must ensure that children are supervised at all times while in the games room. Injury to guests is entirely at the risk of the guest, and the company cannot be held liable for damages caused by the use of the equipment. Any damage caused by the guest to the games room equipment is not covered under the Accidental Damage Waiver. If the equipment in a games room is damaged or has missing parts (cue tips or dart flights/darts), spares or replacement can be collected or purchased from the owner.
PLEASE NOTE: All game room equipment is inspected for damage after a guests departure. Guests staying at a Vacation home in Florida must notify the owner within 1 working day of their arrival of any damage found or breakage. Failure to do so will likely result in additional charges to your credit card.
Pool heating
Gas heat pumps are more efficient at heating the water of pools and spas in all temperature ranges. Typically, a swimming pool at a Vacation home in Florida that is heated by a gas heat pump will heat to the operating temperature (75-85 degrees Fahrenheit) within 1 day. Spa pools will warm to their operating temperature within 15 minutes. Guests should note that on vacation homes offered with gas heated pools, the pool heat charge is higher than on electrically heated units as the fuel costs are higher.
Electrically heated pumps will warm a pool on a Florida pool home to the operating temperature of 75-85 degrees Fahrenheit in 24-48 hours - depending upon the ambient air temperature. Please note that electrical pool heaters utilize a heat exchange pump. If the outside temperature at your vacation home drops below 55 degrees Fahrenheit, then the pool heater will not operate, and the pool will not be heated. If the overnight temperature drops below 50, the pool may not be able to return to the operating temperature range during the following day. In such a case, the money that you were charged for pool heat (only) for that day will be refunded on request
Guests should also note that spa pools provided on vacation homes with electric heat pumps are not hot-tubs, and are not always designed to heat higher than the temperature of the pool. If a guest specifically wishes to have a hot-tub, then they should select a vacation home from our range that have a gas heater and spa pool.
All guests should note that pool heat cannot be guaranteed, as sometimes mechanical devices fail, or environmental factors will not allow the pools to be heated. Guests must notify the owner of failure of pool heat on the day, so that the temperature or the equipment can be checked by personnel. In the event that pool heat purchased by the guest fails to heat the pool to the specified temperature range between 75-85 degrees Fahrenheit, The owner will refund the pool heat for the days it is not provided on request. Guests who book their vacation rental through the owner will need to contact the owner for clarification of the owners policy on pool heating.
Pool Operation and Heating
Pool heating will be switched on during the day ordered as we cannot turn the pool heating on while the villa is occupied by other guests. It may take some time to heat the pool to optimum temperature, depending on ambient air temperature.
Occassionally, during the winter months, if the air temperature drops very low, the heater and the pump cut out as a safety feature.
The heater is a mechanical devise, and as with any mechanical devise, it can be subject to electrical/mechanical failure. In the unlikely event of a breakdown, every effort will be made to repair the heater as quickly as possible.
Guests are not permitted to interfere with the workings of the pool nor are they allowed to change any settings that control the pool heat. The pool heat is set at a temperature that is suitable for the Floridian climate. If guests have concerns regarding the pool or the temperature they must contact the owners to address these concerns. Random inspections of the pool controls will be made by the owners, and if there is any evidence found that these have been tampered with, this will warrant the complete with holding of the guests security deposit.
Keys and Locks
The code number to the front door will be disclosed to our guests one week prior to arrival. This number is changed after each and every booking, and will be set on the day of your arrival. You should not attempt to change the code at anytime. In the event that you forget the code, contact the owners. The guest is responsible for the costs associated with damage incurred attempting to re-enter the property without the proper code.
Game Room
The internal door to the house must be kept closed when not in use as the air conditioning will malfunction. For security purposes, please lock the internal door and switch off the fans and lights as you leave. Never open or unlocks the garage door.
Booking
The sending of the on-line booking form confirms your acceptance of the terms and conditions set out below and as may from time to time be changed and shall be binding on all persons stated on the booking form. Each booking will be confirmed by the owner, as soon as possible after receiving the booking form and deposit and only on receipt of this confirmation by you will the booking be treated as confirmed. Once the owners have confirmed the booking to you and you have paid a deposit, the named person on the booking form will be responsible for the total rental price of the property, as agreed on the confirmation. The remaining balance of the agreed rental cost must be paid 10 weeks prior to your departure. If the full balance of the rental cost is not paid as in accordance with these booking conditions, we reserve the right to cancel your booking and cancellation penalties will apply.
Email Booking
The Company will provide a written quotation by email and/or on screen showing the total rental fee to the Guest for the Property. Quotations are valid for 14 days, unless and until the Property is either booked by a third party, or the Company receives a deposit for the same dates (or part thereof) from any party. Where the Guest agrees by email, facsimile or other written device to book the Property, or where the Guest makes a booking through the secure on-line booking system on our web site, the Company will provide a booking confirmation to the Guest by email. The Guest must pay the requested deposit or payment as defined on the booking confirmation prior to confirmation of the booking. During that period, the Company reserves the right to accept any booking for the Property from a third party, where said third party agrees to payment prior to receipt of payment from the Guest.
Confirmed Booking
On receipt of the required payment from the Guest, the Company will issue a Rental Agreement by email, facsimile or postal mail to the Guest. Only on release of the Rental Agreement from the Company is the booking determined as confirmed.
Owners Access
The owners shall be allowed access at any reasonable time during your stay.
Acceptance
The Guest agrees that payment of the rental deposit sum to the Company will signify their full acceptance of these Terms and Conditions of Rental. The Guest further acknowledges that by payment of the final rental sum, the Guest has received copies of, and/or read and accepted these Terms of Conditions of Rental on this web site.
Payments
The Guest agrees and acknowledges that the Company will not release the Property or any service prior to receipt by the Company of payment in full. Failure of the Guest to pay rental or for any service will result in removal or refusal to supply said service, including, but not limited to provision of accommodation in the Property. Such removal and or refusal will not alter the terms and penalties associated with cancellation.
The Guest agrees to pay the Total Rental Fee as shown on the Rental Agreement within the due dates as set out on the booking confirmation. Final and full payment is due 60 days prior to arrival. In the event of late payment, or failure to pay, the Company reserves the rights to levy the cancellation penalty percentage charges against any money that the Guest has paid in advance and cancel the booking of the Guest. Where the money paid in advance is insufficient to cover the calculated percentage, the Company reserves the right to exercise any legal remedies to pursue the amount owed by the Guest.
We accept no responsibility for price discrepancies on our website or any other marketing materials you may see relating to Casa Paloma Villa Executive. All prices will be confirmed at the time of booking. The rental price for the villa is fully guaranteed when the deposit has been paid and the acknowledgement/receipt has been issues.
Where the Guest chooses to amend their booking 30 days or more prior to arrival, resulting in a change in the property size or location, or a change of dates of stay, a $100 Booking Administration Fee will be levied. Where the guest alters the booking resulting in a reduction in the number of nights, the Company will charge the $100 Booking Administration Fee in addition to the cancellation fee warranted against the number of nights cancelled as described below.
Any changes to existing bookings within 30 days of arrival will not be permitted.
The Company reserves the right to amend rates at any time. Pre-existing reservations, where the Guest has made a payment, will remain at the pre-increase pricing.
Rental Period
The Guest agrees, and the Company permits the Rental Period to begin and end on the dates shown as the Rental Period (as shown on the Rental Agreement).
Basis of Rental
Properties offered for short-term rental through the Company are provided on a self-catering basis. The Company provides complimentary starter soap, toilet paper, and trash bags. Once these items are used, it is the guests responsibility to replenish them. The Guest may elect to order groceries and supplies in advance from the Company at the charges set out.
Security Deposit
The sending of the booking form confirms your acceptance to pay for any damage of any kind caused by your occupancy of the property. The cost of repairs and/or replacements will be deducted from your security deposit prior to the return of the balance. The security deposit will be fully refundable 2-3 weeks after your departure from the property, providing there are no claims against it. In the event of any excess damage of any kind, excessive cleaning costs by our agents excess waste left in the villa, or excessive use of electricity (caused by leaving external doors open with the air conditioning on) the named person on the booking form will be held responsible for all additional costs which exceed the security deposit.
Cancellations
Providing the owners receive written notice of cancellation not less than 6 weeks prior to the actual booking date, the signatory will not be liable to pay the full balance. It is the responsibility of the signatory to ensure that the signed cancellation letter reaches the owner. Email cancellations are not acceptable. The reservation deposit will be forfeited. If the cancellation is received after 8 weeks prior to the start of the holiday the signatory is liable to pay the full balance of the final invoice. If the owner is successful in re-booking the property for all or part of the reservation period, the full balance or the part balance of the final invoice will be refunded. The owners reserve the right to cancel any bookings providing written notice is given and any balance paid refunded. In the unlikely event that circumstances beyond our control, necessitate cancellation of the booking, we will refund any monies paid to the party leader. (Without interest, compensation or consequential loss of any kind).
Cancellation
The Guest may cancel their booking at any time up to or during the Rental Period. In the event that the Guest exercises their right to cancel, the Company will levy the following cancellation penalty percentage rates of the Total Rental Fee (amount shown on the booking confirmation):
" From initial date of booking up to 60 days prior to the arrival date 20%
" Between 30 and 60 days prior to the arrival date 50%
" Between 15 and 30 days prior to the arrival date 75%
" Less than 15 days prior to the arrival date 100%
" No refunds will be given for unfavorable weather, early departure, utility service interruption, construction, or maintenance issues.
The Company regrets that it is unable to waive any of the cancellation charges above, whatever the circumstances. The Company recommends that all guests take out adequate cancellation or vacation insurance either through their insurance broker or travel agent. Alternatively,
Responsibilities
All persons stated on the booking form are responsible for the care of the property and are expected to take reasonable care of it including the locking & securing of all doors, topping up of pool water (as required) and ensuring the security alarm is activated whenever the property is unoccupied. At the end of the rental period, all utensils, carpets, furnishings, walls, fittings must be left clean and tidy. It is the guest's responsibility to notify the management company immediately of any sudden equipment failure so that reasonable action can be take to rectify the situation.
Party Size
The maximum capacity that our villa for is 9 (plus a baby). Everyone occupying the property must be listed on the booking form, including small children. This is Florida state law and must be adhered to. The accommodations cannot be shared or sub-let and only the persons shown on the booking form are permitted to stay in the property. No pets are permitted. Persons under 21 years of age are not acceptable unless accompanied by parents or responsible adults. The owners reserve the right to refuse admittance if this condition is not met. Failure to comply will render the booking void and no compensation will be paid.
No Smoking
For the safety and comfort of all our guests smoking is not permitted within the property.
Pets
Pets are not permitted in the Property. Guests with pets are advised to place their pet at another facility. The Company nor the Owner of the Property can be held liable for any loss or injury to a pet while staying at the Property, or for any action taken against the pet or pet owner by third parties. In the event that the Guest brings a pet to the Property, the Company may elect to evict the Guest from the Property with loss of all rental money paid and/or levy a charge of at least $100 per bedroom per week to the credit card of the Guest, to pay for additional sanitation and cleaning on the departure of the Guest and pet.
Water Usage
Water is a precious commodity in the State of Florida. Please take the utmost care to conserve water during your stay.
Service Level
The Company agrees to a Service Level for the remedy of any problems found at the Property, either on arrival of the Guest, or during the Rental Period, as follows. The Company agrees to provide a maximum 4-hour response to remedy problems that, at the sole discretion of the Company, constitute emergencies, which would affect the safety of the Guest. Any problems arising during the Rental Period at the Property that do not constitute an emergency as determined by the Company will be remedied during or after the Rental Period, based on the severity of the problem, at the sole discretion of the Company.
The company makes all reasonable efforts to maintain each property and its equipment in good working order. Wherever commercially possible, repairs are performed within 24 hours, but sometimes delays are inevitable. No refunds are granted for malfunctioning mechanical or electrical equipment including (but not limited to): inoperable appliances, air-conditioning units, pools and/or spas. No refunds will be given for unfavorable weather, early departure, utility service interruption, construction, or maintenance issues. Additionally, there are no refunds for faulty recording or playback equipment, TVs, audio, telecoms, cable reception, computer equipment or internet access.
Liability
The owners and the management company of the property accept no responsibility whatsoever for death, personal injury, accidents, loss or damage to persons or personal belongings however caused. The use of all accommodations and amenities including the pool is entirely at the user's own risk. Children must be supervised by responsible adults at all times when using the pool. Glass or crockery is not permitted within the pool area. The owners cannot accept any liability for any loss of rental time due to travel problem, flight delays or cancellations, industrial disputes or any events outside our control, including any form of Force Majeure. The owners cannot accept responsibility for the sudden failure of villa equipment but will take immediate reasonable action to rectify any such failure upon notification by the guests. If the pool heater cannot reach optimum temperature due to adverse cold weather conditions the owners or the management company cannot accept liability.
Limitation of Liability
The Owner makes all reasonable efforts to provide advice and safety information. This information can be found in the Home-Pack at the Property. It is the responsibility of the Guest to ensure that they have read and understood the contents and advice given following arrival at the Property. The Owner is willing to provide any and all further information pertaining to the Property providing the Guest has first read the Home-Pack. In addition, the Owner states the following:
" The Owner will not release the physical address of the Property to the Guest prior to the collection of the keys and directions to the Property on arrival. This is a security measure.
" The Owner do not accept liability for equipment failure and or services in the Property. In the event of failure of equipment, the Guest must notify the Company within one working day such that the owner may elect to effect a remedy to the failure.
" The Owner do not accept liability for lost or stolen personal property of the Guest from the Property during the Rental Period. The Owner provide information and advice in the Home-Pack to the Guest in an advisory capacity only, with no guarantee or promise of security, even where the Guest make use of any advice given by the owner or its representatives. In the event that property of the Guest is lost or stolen, the Guest should advise the appropriate authority first, and then the Owner, of the lost or stolen items. The Housekeeper or its representatives may enter the Property at any time, without notice, for the purposes of protection and/or maintenance of the Property. Wherever possible, the owner will notified to the Guest prior to such entrance.
" The Owner accept no liability for personal loss or injury to the Guest during the Rental Period. The Guest must ensure that they have adequate insurance cover. The Owner provide information and advice in the Home-Pack to the Guest in an advisory capacity only, with no guarantee or promise implied.
" The Guest must ensure that Children are supervised at all times. It is the policy of the owner that all Children under the age of 18 years are not left in rental accommodation un-supervised during the rental period.
" The Owner do not accept any liability for the acts or omissions of any agent. These include but are not limited to, airlines, car-hire companies, travel agents, ticket agents, homeowners, or utility providers.
" The Owner do not accept liability for failure of pool heat to provide adequate heating where pool heat is provided via an electrical heat pump, and where the outside air temperature drops below 55 degrees Fahrenheit. Electric heating pumps do not operate effectively below this temperature and failure of such devices to heat the pool is outside of the Company's control, and is regarded as an act of nature (see below). In most cases your pool will warm to a daytime temperture of between 70 and 80 degrees.
" The Owner do not accept liability for acts of violence, nature, fire, flood, war, civil disobedience, riot, or other force majure that may have a deleterious effect on the Guest.
Failure to comply with any of the terms herein will, at the sole discretion of the Company, result in the eviction of the Guest from the Property, without recompense or refund.
Arrival and Departure
The villa will be available for occupancy from 4.00pm on the date of arrival and must be vacated by 11.00am (prompt) on the day of departure.
Insurance
It is a condition of the booking that all members of the Party are covered by travel insurance which carries adequate protection against delays and cancellations, and has adequate medical insurance for the USA, and for your luggage and personal belongings.
Accidental Damage Waiver
The Guest has paid an Accidental Damage Waiver (ADW) premium to the Company or the Owner (amount shown on the Rental Agreement) prior to arrival. The Guest agrees that the Party Leader remains responsible for all loss from the property or its inventory during the Rental Period. The Guest must complete and return the Registration Form (provided on arrival) within one working day to protect their ADW from claims made as a result of accidental damages found during their stay, or within 72 hours following their departure, up to a maximum value of $500.
The Guest agrees that the Company or the Owner can charge additional fees to cover:
" Early arrival or late departure charges
" Non-return of keys
" Loss or breakage of inventory items
" Damage to the Property or its equipment
" Unauthorized Pets
Where loss or damage to the Property, the inventory, or equipment exceeds $500, the Company or the Owner will bill the Guest for the shortfall, and the Guest agrees to pay within 14 days. In the event that the Guest fails to pay any such shortfall, the Company reserves the right to exercise any legal remedies to pursue the amount owed from the Guest. Where the Company finds damage or loss to the Property following the Guests departure that, in the view of the Company, constitutes malicious or wanton damage, the Company reserves the right to notify law enforcement authorities and prosecute, in addition to billing the Guest for the full amount of repair or replacement, and the Guest agrees to pay within 14 days.
Force Majeure
The owner or the management company accept no responsibility whatsoever and no compensation or any other payment will be made if any cancellation or change to the terms of the booking becomes necessary due to war or threat of war, riots, civil commotion, terrorist activities, industrial disputes, natural and nuclear disasters, fire, flood, adverse weather conditions, building or construction in progress within the community, technical problems with transportation, closure or congestion of airports, alterations or cancellation of schedules by carriers, or any other events beyond our control.
Owners Access
The owners or their management company shall be allowed access at any reasonable time during your stay.
Law
This conduct is subject to and shall be construed in accordance with the laws of Wales and all parties hereby submit to the exclusive jurisdiction of the Welsh Courts.
Code of Conduct
Aviana is a residential community. The actions of all members of your party should not interfere with the enjoyment of either other holidaymakers or the residents of Aviana. Please do not use the swimming pool, play loud music or engage in any activity which may cause inconvenience to your neighbors after 10.30pm or before 07.30am. In the event that any member of your party behaves in a way that is likely to cause distress, danger or annoyance to any other holidaymakers, residents of Aviana or damage to any property, the owners or their management company reserve the right to terminate your rental agreement immediately and forthwith. The owners or their management company will not be liable for any costs you will incur, nor shall we pay any compensation, nor make any refunds due to this action.
